You agree to indemnify PIFAA or its directors, employees, associates or partners for all the liabilities (including claims, damages, suits or legal expenses in defending itself in relation to the foregoing) arising due to (i) use or misuse of the Mobile Application /website/knowledge platform (ii) non-observance of the duties and obligations under these terms and conditions or due to your acts or omissions (iii) any act, neglect, misconduct or fraud on your part.

You warrant that all the details and information provided by you to PIFAA or its directors, employees, associates or partners while using this Mobile Application/Website/knowledge platform (including for the purposes of enrolling for our Programs/Membership) shall be correct, accurate and genuine.

Further, you shall be solely responsible for any financial or non-financial decision taken by you based on information provided on PIFAA AOP, and PIFAA shall not be liable for any loss or damage caused to you or other users of this Mobile Application/ website/knowledge platform due to such decisions. You expressly agree that the use of the Mobile Application /website/knowledge platform is at your sole risk.

To the fullest extent permissible pursuant to applicable law, PIFAA AOP, and PIFAA and its directors, employees, associates, third-party partners disclaim all warranties or guarantees – whether statutory, express or implied – including, but not limited to, implied warranties of merchantability, fitness and non-infringement of proprietary rights. No advice or information, whether oral or written, obtained by you from PIFAA or through the Mobile Application /website/knowledge platform will create any warranty or guarantee other than those expressly stated herein.

The application, including any content or information contained in it or any site related service, or any product or service licensed or purchased through the site, is provided on an “as is” basis and without warranties of any kind, either express or implied, including, but not limited to warranties of title or non-infringement or merchantability and fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the applicable laws. Access to and use of the Mobile Application /website/knowledge platform and the information is at your risk and PIFAA does not undertake any accountability for any irregularities, viruses or damage to any computer that results from accessing, availing or downloading of any information from the Mobile Application /website/knowledge platform.

You acknowledge that all interaction, communication, dealing or transaction between the user and the Third-party provider in respect of any products / services offered by the Third-party provider is a separate and independent transaction between the Client and Third-party provider without any liability. You acknowledge that any cost, damage, loss or expenses incurred by us or Third-party arising out of or in relation with any such communication, dealings and transactions between the Client and Third-party providers.

We disclaim any responsibility for any such communications, interactions, deals, or transactions between the users and the third-party providers, and we shall not be held liable for any such consequences as a result of such communication, interaction, deals, or transactions between the users and the third-party providers.

A Third-party providers advertised or offered product or service is not warranted, endorsed, guaranteed, or assumed responsibility by us, and we shall have no commitment or liability for any transaction between you and the such party provider. If you are purchasing a product or service through these Third-party providers, you should use your best judgement and exercise caution where appropriate.

 


 

Consideration

As outlined in the Mobile Application/website/knowledge platform, PIFAA has the right to charge fees to its members for the use of its programs and / or services. PIFAA may alter its fee structure as it deems appropriate at its sole discretion from time to time, and you will be adequately informed prior to such changes. All charges and fees shall be exclusive of taxes and all Government taxes including but not limited to GST shall be payable by you. All charges shall be non-transferable.

 

Dispute / Complaint settlement Policy

If You have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting the PIFAA AOP director. Any Disputes arising from the agreement will be subject to the Jurisdiction of Pune Court.

 

Force majeure

PIFAA shall not be liable for failure or error of any transaction on the Mobile Application/ website/knowledge platform or for any failure on part of the PIFAA to perform any of its obligations under these Terms and Conditions if performance is prevented, hindered or delayed by a Force Majeure event (as defined below) and in such case its obligations under these Terms and Conditions shall be suspended for so long as the Force Majeure event continues. The term “Force Majeure Event” means any event which occurred and is beyond the control of the PIFAA AOP, including without limitations, unavailability of any communication systems, breach, or virus in the processes or payment or delivery mechanism, sabotage, fire, flood, explosion, acts of god, civil commotion, pandemic, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage devices, computer crashes, malfunctioning in the computer terminal or the systems getting affected by any malicious, destructive or corrupting code or program, mechanical or technical errors/failures or power shut down, faults or failures in telecommunication etc. PIFAA shall be discharged from such performance to the extent of and during the period of such Force Majeure Event, and such non-performance of its obligations shall, in no event whatsoever, amount to a breach of its obligations.

 

Severability 

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

 

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

PIFAA is conference for Personal Financial Advisors and provides knowledge-driven exclusive content to its Members through Memberships, Live Sessions, recordings and other channels as it deems fit (“Services”). PIFAA is committed to operating its Mobile Application /website/knowledge platform with the highest ethical standards and appropriate internal controls.

This is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder and the amended provisions pertaining to electronic document/records in various statutes as amended by the Information Technology Act, 2000 and these do not require any physical, electronic or digital signatures.

 

Terms of Use

Please read the rules and restrictions that govern your use of our Mobile Application /Website/ Knowledge Platform and Services. These Terms and Conditions (the “Terms”) are a binding contract between you and PIFAA. By using the Services of PIFAA, you are confirming that you are above the 18 years of age and legally eligible to enter into a legally binding contract, enforceable under Indian law, including the Indian Contract Act, 1872. You agree that you will not use the Services in any manner or engage in any activity that may damage, disable or impair or adversely affect the use of the Mobile Application /website/ knowledge platform or interfere with any other users’ use, legal rights, or enjoyment of the Mobile Application /Website/Knowledge Platform. Further, you agree not to remove any text, copyright or other proprietary notices contained in the content downloaded from the Mobile Application /Website/Knowledge Platform.

You expressly understand and agree the terms and conditions, privacy policy published on the Mobile Application/website/knowledge platform of PIFAA. If you are having trouble accessing your information online and would like to change or delete your personal information or other information that you have provided, you may contact us immediately at pifaainternal@gmail.com.

If there is any change in the account information, you shall promptly update your account information to PIFAA. PIFAA would rely on the most recent information provided by you.

PIFAA and its employees may contact you by phone, email, SMS, or any other form of electronic communication regarding your registration, advisory, and transactions or for any other specified or non-specified purpose. This consent overrides any registration for DNC/NDNC and agrees to take steps to deregister from the DND list and shall not hold PIFAA liable for non-receipt of SMS. You can always opt to stop receiving any or all such communications or delete your account from the knowledge platform, or by writing to pifaainternal@gmail.com.

Translation Interpretation

These Terms and Conditions may have been translated if PIFAA have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

 

Changes to These Terms and Conditions

PIFAA reserves the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, PIFAA will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

Return, Refund & Cancellation Policy

At PIFAA, we strive to provide edge to personal finance professionals across India with the best possible experience. However, we understand that there may be instances where You may need to request a refund or return a product. Our refund and return policy are designed to address such situations in a fair and efficient manner.

 

Refund and Cancellation Policy

  • PIFAA FuturePro Registration Membership: PIFAA Conclave Membership is non-refundable.
  • PIFAA Membership Fee’s of any nature are non-refundable
  • Administration Charges: 5% will be deducted as an administration charge on all payments and such payments will not be refunded
  • GST Charges: The GST amount will not be refunded.
  • Early Bird or Discount codes Availed: Once the payment has been made and discounts code have not been availed, the difference amount will not be refunded.
  • Cancellation Policy: PIFAA Conclave Membership is non-cancellable.

Return Policy

Non availability of any products: Due to the nature of services what we cater at PIFAA, we do not offer returns or refunds for any kind.

Shipping Policy - Due to the nature of services what we cater at PIFAA, this can be Mentioned as Not Applicable

Duplicate Payment

  • In case of duplicate payments, we will process a refund of the duplicate amount via the original method of payment within 10 working days after receiving the customer’s request.

Please note that PIFAA reserve the right to revise the terms & conditions of this policy without any prior notice.

 

Note: Refunds will be processed within one month after the refund request is approved by PIFAA Core Team.
